By accessing and using ShiftReply ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

ShiftReply is a web-based platform that enables business owners to collect availability information from their employees via email. The Service allows you to:

  • Send availability requests to employees
  • Collect employee availability responses
  • View consolidated availability data
  • Export availability information

3. Account Registration

To use the Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 18 years old or have parental consent
  • Be legally authorized to represent the business using the Service

4. User Responsibilities

You agree to:

  • Use the Service only for lawful purposes
  • Not misuse or abuse the Service
  • Obtain proper consent from employees before adding their contact information
  • Comply with all applicable email and messaging regulations
  • Not transmit spam, harassment, or unsolicited messages
  • Maintain accurate employee contact information

5. Pricing and Payment

ShiftReply offers subscription plans at $10/month or $100/year. You agree to:

  • Pay all fees associated with your subscription
  • Provide valid payment information
  • Allow automatic renewal unless cancelled

We reserve the right to change pricing with 30 days' notice. Changes will not affect your current billing cycle.

6. Free Trial

New users receive a 14-day free trial with full access to all features. No credit card is required for the trial. After the trial period, you must subscribe to continue using the Service.

7. Cancellation and Refunds

You may cancel your subscription at any time from your account dashboard. Cancellation will take effect at the end of your current billing period. No refunds are provided for partial months or unused portions of annual subscriptions.

8. Data Ownership and Usage

You retain ownership of all data you input into the Service. We do not sell or share your data with third parties except as required to provide the Service (e.g., email delivery).

9. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue the Service with reasonable notice.

10. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for:

  • Lost profits or business opportunities
  • Data loss or corruption
  • Service interruptions or errors
  • Employee scheduling decisions made using the Service

11. Intellectual Property

All content, features, and functionality of ShiftReply are owned by us and protected by copyright, trademark, and other intellectual property laws.

12. Termination

We reserve the right to terminate or suspend your account if you violate these Terms of Service. Upon termination, your data will be deleted after 30 days.

13. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes via email or in-app notification. Continued use of the Service constitutes acceptance of updated terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved in accordance with applicable law.
